Testing jQuery 1.6.1 locally as well as on jsFiddle.net, I haven't been able to reproduce the issue you're experiencing in IE8. Here is also a jsFiddle test using our edge version which is also working fine in IE8 without the error mentioned http://jsfiddle.net/dM6fu/.
