SCRIPT5007: Unable to get value of the property 'nodeType': object is null or undefined

it fails in IE8/IE9:

attr: function( elem, name, value, pass );

elem is undefined

You are using elem before checking if it is undefined

my fix:

nType = elem ? elem.nodeType : undefined;
