IE html5 Elements are not "activated" when you convert them to a jquery object first

this is working in IE 7/8 with jQuery 1.7+

$("body").append("<nav />");

the nav element is "activated" and can be styled with css.

this does not work:

$("body").append($("<nav />"));

if you convert a string containing html5 elements to a jQuery object before you add it to the dom, the html5 elements are not "activated" for ie7,8.

this is a unconsistent behavior. sometimes you need to create a jQuery object first to do some more manipulation before adding it to the DOM.
