Unable to set value of the property 'innerHTML' with HTML5 in IE8 and IE7

Description
When using HTML5 elements (we included html5shiv) we got the error: "Unable to set value of the property 'innerHTML': object is null or undefined" on line 1658 on IE8 and IE 7.
