animate() not working in ie8 and under with latest script link

Description
was linking to the latest versions using
<script src="http://code.jquery.com/jquery-latest.js" type="text/javascript"></script>
<script src="https://ajax.googleapis.com/ajax/libs/jqueryui/1.8.18/jquery-ui.min.js" type="text/javascript"></script>
however ie 8 and under would refuse to allow animate() to work at all giving an invalid argument error from the jquery script.

Because we get so many tickets, we often need to return them to the initial reporter for more information.
